Are you an expat living or working abroad in the Netherlands and suddenly facing issues at work? Why expats abroad need specialized legal dismissal support in Amsterdam
- sudden termination or dismissal
- unfair accusations or workplace conflict
- problems during probation
- non-renewal of a contract
- dismissal during illness
- immigration or residence concerns tied to employment
We know how stressful dismissal can be when your life, home, or visa depends on your job. That’s why we act fast and strategically, protecting both your rights and your future.
Common types of dismissal expats encounter
1. Immediate dismissal (ontslag op staande voet)
This is the most drastic form of termination in the netherlands. It applies only in extreme situations, such as alleged misconduct. The employer must prove a serious reason, immediate action and proper explanation.
If this procedure is not followed correctly, the dismissal may be invalid. Many expats do not realize they can challenge such a dismissal and even claim compensation with the help of a solicitor or lawyer.
2. Court dismissal (ontbinding via kantonrechter)
- a disturbed working relationship
- alleged poor performance
- long-term illness
- other legal grounds
The court decides whether the contract ends and whether you are entitled to compensation.
3. UWV dismissal (for economic or reorganization reasons)
- restructuring
- job redundancy
- partial or full business closure
If approved, the employer may terminate the contract with proper notice.
4. Mutual termination: the settlement agreement (vaststellingsovereenkomst)
- a fair severance package
- protection of your visa or immigration status
- neutral wording for future employers
- continued salary during notice periods
- time to find a new job
- protections while on sick leave
Never sign a settlement agreement before an expert reviews it.
Severance pay: what expats should expect
- the statutory transition payment
- an additional fair compensation in certain unfair situations
We negotiate on your behalf to ensure you receive everything you are entitled to.
