Petition for divorce

Several additional measures might be required, besides the divorce, such as alimony, arrangements concerning parental access and the division of property. Your partner’s lawyer might submit a written defence. Verbal discussions follow next, and a verdict is generally reached afterwards.

It is still possible for the parties to come to an agreement at any stage during the proceedings. The court may, on request of our lawyers Divorce and Family Law, make provisions for during the divorce proceedings, for matters such as: who will be permitted to stay in the marital residence, who will be assigned provisional custody of the children, should alimony be paid?
Joint petition for divorce
Our lawyers Divorce Law in Amsterdam can also file a joint petition for divorce, if both partners opt for divorce together, and one lawyer is used.
This is only possible if the spouses are in full agreement.
Our Dutch lawyer Family Law subsequently draft a memorandum of understanding, which includes everything that was agreed on, like:

- division of pension.
The memorandum of understanding may form part of the divorce order.
Divorce and mediation in Amsterdam
