What are the costs of reviewing a settlement agreement? If your Dutch employer wants to dismiss you by means of a settlement agreement and you want legal advice or assistance with the proposal, the employer will in principle pay the costs of a lawyer for the settlement agreement.

Compensation for legal costs

The settlement agreement almost always includes an amount as compensation for legal costs for legal assistance and advice on the settlement agreement. The contribution for a legal settlement agreement check averages between €750 and €3000 excluding VAT, depending on the complexity of the case.

Legal advice

The employer assumes that you, as an employee, will first seek legal advice from a lawyer or legal expert before agreeing to a termination agreement. This is not surprising, given the risks associated with a settlement agreement, such as the right to unemployment benefits, the correct calculation of the transition allowance, or the fictitious notice period during which you will not receive unemployment benefits.
